The deadlines, rights and steps that Michigan law and the state insurance department set for a water damage claim. Each point links to the statute or state page it comes from.
What to Do Right After the Water
- Stop the source if you can do it safely. Turn off the water main or the breaker for wet rooms.
- Photograph and video everything before you move or throw anything out. FEMA gives the same advice for flood claims.
- Notify your insurer or agent as soon as possible. Write down the claim number and the date you called.
- Protect the property. DIFS tells homeowners to take reasonable action to minimize the loss.
- Start drying within 24 to 48 hours. EPA says wet areas dried in that time usually do not grow mold.
- Keep every receipt for emergency work, hotels and supplies.

Proof of Loss, Payment and 12% Interest
Your insurer decides what proof of loss it needs. Michigan law requires it to list those materials in writing within 30 days after it gets your claim. After it receives satisfactory proof, it has 60 days to pay. A late payment earns 12% simple interest a year, unless the claim is reasonably in dispute.
“An insurer shall specify in writing the materials that constitute a satisfactory proof of loss not later than 30 days after receipt of a claim unless the claim is settled within the 30 days.”
MCL 500.2006(3), Michigan Legislature“If benefits are not paid on a timely basis, the benefits paid bear simple interest from a date 60 days after satisfactory proof of loss was received by the insurer at the rate of 12% per annum”
MCL 500.2006(4), Michigan Legislature“Failure to pay claims on a timely basis or to pay interest on claims as provided in subsection (4) is an unfair trade practice unless the claim is reasonably in dispute.”
MCL 500.2006(1), Michigan LegislatureWhat We Give Your Adjuster
A dry-out leaves a paper trail. We hand you and your adjuster the same file:
- Dated photos of the source, the water line and each wet room
- A moisture map with readings for every wet area, every day
- The IICRC S500 water category and the reason for it
- A list of materials removed and why each could not dry in place
- Equipment logs: each dehumidifier and air mover, and the days it ran
- Final dry readings and an itemized invoice
If You Disagree With the Amount
Appraisal
Either side may demand appraisal in writing. Each names an appraiser within 20 days. The two pick an umpire, and two of the three signatures set the amount. Each side pays its own appraiser and splits the umpire's cost.
DIFS complaint
Try to resolve it with your insurer first. Then call the Michigan Department of Insurance and Financial Services at 877-999-6442 or file online.
Public adjuster
A licensed public adjuster works for you. The fee is capped at 10% of what the insurer pays, under a written contract on a state-approved form.
Time to sue
At least 1 year after the loss, or the policy period if longer. The clock stops from your notice until the insurer formally denies the claim.
Actual Cash Value, Replacement Cost and Holdback
Replacement cost is the cost to rebuild with like material, with no deduction for depreciation. Actual cash value is replacement cost less physical depreciation.
A Michigan replacement cost policy may pay actual cash value first. The rest, often called recoverable depreciation, is paid after the property is actually repaired, rebuilt or replaced.
“unless the lost or damaged property is actually repaired, rebuilt, or replaced at the same or another contiguous site”
MCL 500.2827(3), Michigan LegislatureFor personal homeowners policies issued or renewed on or after July 1, 2025, an insurer that depreciates labor, taxes, fees, or overhead and profit must do it through a separate endorsement.
“insurers that wish to depreciate nontangible items as defined herein must do so by a standalone endorsement specifically identifying the nontangible items subject to depreciation, rather than through definitions found in the policy form”
DIFS Bulletin 2024-26-INS, Depreciation of Nontangible Items (Nov 8, 2024)Flood Water Needs a Flood Policy
The state insurance department says most homeowners and renters policies do not cover flood damage. Flood coverage usually comes through the National Flood Insurance Program (NFIP).
- A new NFIP policy usually takes effect after a 30-day wait. DIFS Consumer Counselor FIS-PUB 0215
- NFIP covers only a short list of items in a basement. FEMA NFIP Summary of Coverage (P-2144, Dec 2023)
- NFIP excludes seepage and sewer backup not caused by a flood, and mold the owner could have avoided. FEMA NFIP Summary of Coverage (P-2144, Dec 2023)
- Send claim documents within 60 days of the flood, or by the date your adjuster sets. FEMA FloodSmart Claims Checklist
Sewer Backups: the 45-Day Notice
If a public sewer or storm drain backed up into your home, you may have a claim against the government agency that runs it. The notice deadline is strict.
To win, you must show the agency knew or should have known of a defect and did not fix it in a reasonable time. A blockage in your own service lead, or a sump, drain or downspout on your property that caused half or more of the backup, defeats the claim.

What WaterOut Does on a Claim
We are a restoration contractor. We remove the water, dry the structure and document the work for you and your adjuster. We answer the adjuster's questions about the work we did.
Michigan law requires a license to adjust a loss or to give advice on coverage. Coverage and settlement questions go to your agent, your insurer, a licensed public adjuster, or a lawyer.
“A person shall not adjust loss or damage under a policy of insurance or advertise, solicit business, or hold himself or herself out to the public as an adjuster unless he or she is licensed as an adjuster.”
MCL 500.1222(1), Michigan LegislatureMichigan Water Damage Claim Questions
How long does my insurer have to pay a water damage claim in Michigan?
Under MCL 500.2006, the insurer must tell you in writing within 30 days what proof of loss it needs. If it does not pay within 60 days after it receives satisfactory proof of loss, it owes 12% simple interest a year, unless the claim is reasonably in dispute.
Can I start drying before the adjuster comes?
DIFS tells homeowners to take reasonable action to minimize the loss. EPA says wet areas dried within 24 to 48 hours usually do not grow mold. Photograph the damage before anything is moved, and tell your insurer that drying has started.
What if I disagree with the insurer's number?
Michigan fire policies, which include homeowners policies, carry an appraisal clause under MCL 500.2833. Either side can demand appraisal in writing. Each side names an appraiser within 20 days, the two pick an umpire, and two of the three set the amount. You can also file a complaint with DIFS at 877-999-6442.
Does homeowners insurance cover flooding?
DIFS says most homeowners and renters policies do not cover flood damage. Flood coverage comes from a separate policy, such as one through the National Flood Insurance Program. A new NFIP policy usually has a 30-day waiting period.
My basement backed up from the city sewer. What do I do?
To claim against a government agency for a sewer backup, MCL 691.1419 requires written notice within 45 days after you discover the damage. The notice needs your name, address and phone, the property address, the discovery date, and a short description. Keep a copy.
What is recoverable depreciation?
A Michigan replacement cost policy may pay actual cash value first and the rest after the property is actually repaired or replaced (MCL 500.2827). For policies issued or renewed on or after July 1, 2025, depreciation of labor, taxes, fees, or overhead and profit needs a separate endorsement (DIFS Bulletin 2024-26-INS).
Can WaterOut talk to my insurance company for me?
We send the adjuster our photos, moisture readings, drying logs and invoices, and we answer questions about the work we did. Negotiating your claim or advising you on coverage needs a license in Michigan (MCL 500.1222 and 500.1232). For that, talk to your agent, a licensed public adjuster, or a lawyer.
What does a public adjuster cost?
Under MCL 500.1226, a public adjuster may charge no more than 10% of what the insurer pays, under a written contract on a state-approved form. A contract signed within 48 hours after the loss can be voided within 10 days.
